Terms of Service

The terms that apply when you use the Social Media Post Creator, including trials, billing, cancellation and your content.

These terms apply to the Social Media Post Creator (the "Service"), provided by Googolplex Ltd (trading as Googolplex Marketing), a company registered in England and Wales with company number 13518352, whose registered office is at 22 St James's Avenue, Hampton Hill, TW12 1HH. By starting a trial or subscription, or by using the Service, you agree to these terms, our Fair Use Policy and our Privacy Policy.

‍1. Who can use the Service

The Service is for businesses only, including sole traders. By using it, you confirm that you are acting for the purposes of your trade, business or profession and not as a consumer, that you are at least 18, and that you have authority to accept these terms for that business.

2. Your account

Each account covers a single business or brand, as set out in our Fair Use Policy. You are responsible for keeping your login details secure and for all activity under your account. Keep the information you provide accurate and up to date, and tell us straight away if you think someone else has accessed your account.

3. Free trial

New subscriptions include a 7-day free trial. You need to add a payment card to start it. If you do not cancel before the trial ends, your subscription starts and your card is charged on day 8. One free trial is available per business.

4. Plans, billing and renewal

5. Cancellation and refunds

You can cancel at any time using Manage Subscription in your dashboard. Your access continues until the end of the billing period you have already paid for, and you will not be charged again. We do not provide refunds for partial billing periods, including the unused part of an annual plan.

6. Clients on a Googolplex Marketing retainer

If your access is included in, or billed through, a Googolplex Marketing retainer, sections 3 to 5 do not apply. Your access, fees and notice periods are governed by your retainer agreement, which takes priority if it conflicts with these terms. The rest of these terms apply to your use of the Service.

7. Acceptable use

You must use the Service lawfully and in line with our Fair Use Policy. You must not try to copy, reverse engineer, resell or interfere with the Service, or access it through automated means.

8. Your content

You keep ownership of the brand details, logos, product images and other material you add to the Service, and you confirm that you have the rights to use that material. You give us permission to store and process it only as needed to provide the Service. This includes passing it to the third-party providers named in our Privacy Policy, such as the AI provider that generates text and images.

10. Our Service and intellectual property

We own the Service, its software, design and underlying technology. These terms give you a right to use the Service while your subscription or retainer access is active, and nothing more.

11. Availability and changes

We aim to keep the Service available but cannot guarantee uninterrupted access. It relies on third-party providers, and we may carry out maintenance. We may change or improve features from time to time. If a change removes something central to the Service, we will tell you in advance where we reasonably can.

12. Suspension and termination

We may suspend or end your access if you breach these terms or our Fair Use Policy, or fail to pay. Where possible, we will contact you first and give you a chance to put things right. After your account ends, we will keep your brand details, uploaded images and content library for 90 days and then delete them, except where the law requires us to keep records for longer.

14. Changes to these terms

We may update these terms. We will email you at least 30 days before any significant change takes effect. If you keep using the Service after that date, the updated terms will apply.

15. General

These terms, together with our Fair Use Policy and Privacy Policy, form the whole agreement between you and us about the Service. If any part is found unenforceable, the rest still applies. No one other than you and us has any right to enforce these terms. These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
